Legalising unauthorised works
Bringing unauthorised construction and changes of use under the current provisions, with the necessary drawings prepared, fines calculated and the file submitted electronically.
An αυθαίρετο is any construction or change of use carried out without the required building permit, or beyond what the permit allowed. The Κώδικας Χωροταξίας και Πολεοδομίας (Spatial Planning and Urban Planning Code) in force provides for υπαγωγή, formal inclusion under the regularisation provisions, of unauthorised constructions and changes of use carried out before 28 July 2011, with different categories according to the date of construction and the type and scale of the breach. For categories 1 to 4 the deadline set by law is 31 March 2028, while category 5 follows a different regime.
Work starts with a site inspection and a detailed survey of the property as it stands, combined with a check and comparison of the approved drawings and the other available details of the property. On the basis of the findings, the planning breaches are identified, whether they can be brought under the provisions in force is examined, and the fine due is calculated through the ΤΕΕ information system. The necessary drawings and supporting documents are then prepared and the declaration is filed electronically. The procedure is completed in line with the conditions and stages the law provides.
Regularising unauthorised construction is a key stage in bringing a property into planning order and in transferring it. Where it is needed for the preparation of the Ηλεκτρονική Ταυτότητα Κτιρίου (ΗΤΚ, Electronic Building Identity) and the issue of the Certificate of Completeness (Πιστοποιητικό Πληρότητας), any breaches found must first have been brought under a regularisation scheme in force, or their lawful treatment secured.
