Planning due diligence
A legality check before purchase or transfer: building permits, approved drawings, the condition on the ground, and any unauthorised works or outstanding issues.
We check the planning legality of a property before a purchase, a sale or an investment decision. We retrieve the building permit file from the competent Υπηρεσία Δόμησης (the local building authority), examine the approved drawings and compare them against the building as it actually stands, as shown by measurements taken on site. The comparison shows whether what exists matches what has been approved, or whether there are deviations in floor area, height and so on.
Each deviation found is assessed for whether it can be brought under a regularisation scheme, in accordance with the provisions of the Κώδικας Χωροταξίας και Πολεοδομίας (Spatial Planning and Urban Planning Code) as currently in force. Unauthorised works and changes of use carried out before 28 July 2011 that fall within categories 1 to 4 can, subject to the conditions of the law, be declared until 31 March 2028. Cases that cannot be brought under a regularisation or legalisation scheme are an open issue that may affect whether the property can be transferred.
The check also covers the details needed for the transfer, such as the Ηλεκτρονική Ταυτότητα Κτιρίου (ΗΤΚ, Electronic Building Identity), a topographic diagram tied to ΕΓΣΑ ’87 (the Greek national geodetic reference system) and agreement between the property and the Cadastre’s records.
What it covers

What we need from you
- Title deeds and historic deeds.
- The ΚΑΕΚ code.
- The drawings of the building permit, where they exist.
- The drawings attached to the establishment of the horizontal properties, where the property is a horizontal property.
